Hi guys. My employment was tupe'd a few weeks ago. The new company is located approx 40 miles further away. They have kept my orginal place of work, but there is no work for me and some others there so we are working in the office 40+ miles away. At the moment I have no complaints as I am using a company vehicle so no cost of travelling for me and I am finishing an hour earlier to adjust for the extra travelling time. I'm not expecting this to last forever, if they do turn around and say I need to work in the new location permantley and have to make my own travel arrangements and work my contracted hours will I be causing myself problems by accepting working there under the current arrangements (use of car - early finish) but then claiming breach of contract once it's made permanent(own car - normal working hours?)

I think you have to consider it as a redundancy situation.
Ask what the plans are to put work back to your current location0 -
My thoughts are that it might be wise to give them a letter (copy kept) making it plain that your old workplace is your workplace and you will continue to regard it as being so - and are just temporarily "helping out" at your new workplace until such time as work is made available for you at your old workplace.
Of course - this depends partly on whether you would prefer to be made redundant, rather than TUPE'd over. Only you know whether that is the case.
My suspicions are that they are trying to wheedle you all surreptitiously into working in the new workplace and are deliberately being "helpful" in allowing this to be in worktime/at work expense for just long enough to get you all "established" there and will then "pull up the drawbridge" and say "Thats it - you are HERE now and no help with being here...tough luck...you've been doing it for some time. So THIS is your workplace now and you have accepted it by the fact that you've kept coming here" and laugh in your face if you say "But YOU accepted its not really our workplace - by giving us the help you did with commuting here at your expense/in your time".
Sorry to say that - but I tend to think they are deliberately making sure there isnt/never will be any work for you at your old workplace.0
