Anyone had a court claim thrown out?

I filed a claim against Lloyds TSB, followed all the rules and used standard letters. However, when it came to the court papers, it was thrown out at the last hurdle on grounds that there was "no grounds for a claim". :confused:

Lloyds TSB still coughed up, but I'm just curious! It was Peterborough Court btw.

    That's probably one for https://www.Consumeractiongroup.co.uk. I have read of a couple on there, but it was because they hadn't claimed correctly. You were lucky they paid out before they realised that it was going to be thrown out. It just goes to show the banks think they are in the wrong. The more I think about it I am sure some on CAG would like to hear about your case.

    I would definitely run this one by CAG. It might also be worth writing to the court manager at Peterborough pointing out that the defendants settled out of court so you dispute the findings and ask on what basis there was no grounds for a claim. Probably won't get you anywhere but might help some other soul not to end up in the same position. Lloyds will have received the same notice and it may give them the confidence now to defend claims.

    What did you allege in your particulars?
    How was it "thrown out"? Things do not get thrown out of (civil) court: they are struck out / summary judgment is granted / dismissed for want of jurisdiction etc.
