Is my Ex girlfriend liable for her half of the rent ?

    So if it were to go to court am i right in asuming that the court would listen to my explanation, then to hers, then see my "evidence" of a signed 12 month lease by her, plus 6 monthly direct debits into my account which stopped when she left and then make a decision based on those facts?

    they would want to see your payments of the rent in advance as well.

    Well id say i have a case then, i have 12 month joint lease signed by us both. I have bank statements showing two deposits of the same amounts into the estate agents accounts which total to the total for the 12 month lease. I have bank statements with 6 direct debit payments for half the monthly rent into my acount from her account on the same date every month for 6 months from the start of the lease untill she moved out.

    Great. Give her a ring and tell her all that, and if she doesn't cough up immediately, you'll see her in court.
    See if she rolls straight over and sends you a cheque. Please report back with what happens next..........

    You have a case. However, winning is all about evidence. If you have sufficient evidence that you paid the 12 months from your own money - and that she promised to pay that rent back (in writing is perfect) and if you can prove all the payments she has made and show all those missed payments, then you have the chance of winning.

    If it's just "then she said ... so I said .... and then she said ... so we .... and then ...." verbally, then it's not worth your while pursuing it probably.

    Evidence. Proof. Documentation. Dates. Signatures.

    What've you got?

    wouldnt the signed contract on the lease constitute a written intention to pay?
