The "Pending Prosecution" question

We've all come across it, but what does it actually mean? When you're asked the question on your motor insurance application, how do you define the concept of a pending prosecution?

We're debating this on the Pepipoo forum and I'd be interested in the thoughts over here...

My opinion (FWIW) is that once you are in receipt of an NIP addressed to you after identifying the driver, or after declaring driver's details to satisfy a S172 request where an allegation has been made, there is then a pending prosecution.

Thoughts? Anyone have the insurers' definition to hand?

    Pending prosecution is when you have been charged by the Police but not yet gone to Court.
