Lloyds TSB - PPI Credit Card & Loan - Before July 2000

Hi,

My mother was mis-sold a few PPI loans to pay off her credit card around 1997. (She is unsure of the dates of when the other loans were offered and taken out, but they did show up on the branch's computer today)

She went into her local branch today to ask about the procedure in reclaiming the PPI. When the bank manager searched by post code and surname, it brought up the records of the loans, but he would not print out a copy, and suggested she calls up the helpline who would not help due to it being more than 6 years.

Could she send a subject access request to Lloyds TSB to get all the details required about the PPI on the loans & credit card.

What is the chance of her being able to reclaim some of the money?

    You can request for a SAR, but again whether or not they will supply the details, as they may come back and try saying they do not hold data going back more than the last 6 years, even though you called into the branch and it have been shown on the computer.
    Saying that personally I would request for a SAR if you've no account number for the loans/credit cards etc.

    Because you can still make a reclaim with whatever reasons there are with just having the account numbers.

    Your in your right to ask for any data they hold on the account, and if your mum banked with these, as long as she enclosed the bank account number on the SAR, this should cover for all accounts taken out by them.

    There is a SAR template letter for this below link, enclose £10 cheque or postal order and they have 40 calendar days to comply.

    However, if you want to continue to make a reclaim and you do not hold the account numbers of each account, you could state that you called into the branch where the details were held on the database as proven and you wish to make a reclaim on all PPI mis sold on each account.

    You can so this by either completing the reclaiming questionnaire, issued by the FOS to save time later, where you complete and send to Lloyds complaints, and keep a copy in case you need to make a complaint to the FOS later on, or write a letter in your own words, the questionnaire replaced the first template letter on this site, and you will find this on the link below as stage one.

    They have 8 weeks as the normal timescale, they may write to ask for more time, but should keep you informed of the progress of the complaints.

    My mother has the account number for the credit card, the account number for the current account, and only one of the loan numbers.

    The TSB Personal Financial Statement issued on 10th April 2000, shows one of the loans but not previous ones, and she isn't sure whether she took one out afterwards. Each time they offered her an un-secured loan as a way out of her financial situation. She was already in financial trouble at this stage and sent a letter on 20th April 2000 with advise from the CCCS to cancel all direct debits/standing orders including the loan ones.

    She only has a limit record of one of the loans, which I've added below:

    Loan number - xxxxxxxxxxxxxx
    Loan Start Date - 10th April 1997
    Loan End Date - 30th March 2002
    Your monthly payment - £319.26
    Covered by loan protection - Yes
    Installments left to pay - 24
    Amount left to pay - £7,662.24


    What would you advise her to do next? Would she still need to send off the SAR letter? She has also got a SAR letter for the bank charges which is below, does this need to be sent off as well?

    I am writing to request that you forward me a copy of all data held by your organisation about me for both current and closed accounts. This should include, but not be limited to all transaction lists, agreements, notes made on my account and copies of letters relating to my account.

    This request should include any data held for more than 6 years as under the Data Protection Act there is no time limit for information requested. If you do not hold data for a period longer than 6 years I also request confirmation of this in writing along with your methods used for disposal of such information to comply with the Data Protection Act stating the name and contact information of your registered Data Controller and Code Compliance Officer.

    I look forward to your response within 40 days, as Lloyds TSB Bank is obliged to reply within this time under the Data Protection Act. If not I shall seek remedy from the Information Commissioner. I enclose the statutory maximum fee of £10.

    If all with the same bank, the link I posted above (SAR) should cover all accounts, and they should supply statements as well as everything else.
    It does entail more on the SAR on the link i posted but this way they should include everything.
    And with it being the same bank you only have to enclose £10 cheque or postal order.;)

    But of course by having most of the details already you may save yourself a tenner, but if you were to send off for a SAR, maybe the link i posted would be better perhaps.

    I need advise please. Can the bank claim not to have details of the requested information (SAR) after they claimed that they 'defended' my claim? what information then did they look at before 'defending' the claim if their excuse is that it dates way back before 2000?
