Sickness and redundancY

Hi

I am currently on sick and don't think i will be returning to work before i am made redundant (1st week in May)....will being on sick affect my redundancy at all? In terms of it being earlier or in payout?

    I think it is up to the individual company as they can offer you a shorter date if you are off sick to get rid of you quicker or request that you go on garden leave and not return. Get some advice from your HR department as each organisation tends to be different on this.

    I am in a similar situation.

    I was advised that they are separate cases and cannot be looked at together.

    With regards to my sickness I have been told to continue visiting the doctor for my unfit to work notice and to obtain a copy of the companies capability policy. As I have been off for a number of weeks instead of making me redundant they could claim I cannot carry out my duties therefore they could get rid off me on capability.

    If you contact ACAS they will be able to give you advise to suit your needs.

    well my husband is disabled and has been told he will be made redundant, however they now say as he has been off for some time they will be giving him a disiplinery due to his capabilities and doing away with his post in the company despite the fact he sent him a letter asking him to express interest in redundancy, he did this straight away by phone and requested they send out written details thenthe next letter arrived saying the above.
    my husband is having constant treatment at the hospital and doctors and the company have been sending him to their doctors. they all agree about the detriment of his condition, so now company which whom he has been employed for for 5yrs want to penalise him for being disabled
    truly truly shocking

    Helpersos i do hope everything works out for your husband ans xyt you also. My workplace have now agreed to pay for counselling for me due to the job i do. I am still unsure what will happen but i may have to consider going back on reduced hours before i am made redundant, but i shall see how things go as at the moment it is not something i can even think about.xx

    They are not penalising him for being disabled, they are penalising him for not being able to do the job, the company should be making reasonable adjustments where possible but if your husband cannot do the work he is being paid for (whether he is getting SSP or contractual or just the fact he is still accruing holiday pay) then the company has every right to minimise their costs and go through the procedures to dismiss him.

    olliesmummy have you got any annual leave to take? I finished my long term sick leave and have gone straight onto annual leave which is supposed to see me through until my redundancy date. And I asked for pay in lieu of notice as well, if that helps any? Or you can keep being off sick and then ask for pay in lieu of notice?

    That is exactly what could happen to I or olliesmummy. As we are off sick the companies we work for could also argue we are not fit to carry out our duties and they can dismiss us for that. The company your husband works for is not penalising him for being disabled they are saving themselves money by seeing him out another door.

    Your husband should request a copy of the capability policy and seek advise either through ACAS or a solicitor.

    I was due to be made redundant at the end of this month and now there is delays so I may have to go back to work until it is resolved although I desperately do not want to go back there I just want to move on.
