    You say his car is worth £300. So the most he would get would be £150.

    Should it come to this (50/50) you could pay him the £150 and retain your NCB.

    As its going 50/50 doing the case may not be a good idea as if you open a claim against him, he may counter claim and then if he wins the counter claim you will have to pay 50%.

    Unfair I know, thats why I pull my phone out and secretly record them, I have slipped up, as I did't record once, thinking I did :(.

    You are correct, the claimant will only get back half all his costs, and also have to pay the other person 50% of his claim if any.
