Equita Bailiffs Advice Needed Urgently

    hi everyone
    i'm in the same situation....my council tax was handed over to the bayliffs as i paid a week late on the payment plan....the amount handed over was £303 inc the liabitilty order charge...
    After the company claiming my postdated cheques didn't arrive i then had to set up an arrangement again.....i paid £200 and after paying i realised that the balance was alot more than it should be....


    i called the company where no one on 3 numbers could tell me the reason for the increase....the bayliff himself has only been once to drop a letter off....in between me paying and the bayliff calling back for the next payment a letter arrived threatening to take my stuff unless i apid now gwtting fed up with the situation i sent a cheque for the amount on the letter.....on monday the day the payment was due the bayliff called and i explained i had received this letter and had posted the payment, yesterday i received a letter saying unless i paid the debt would be handed back to the council who will get a priso order.....today my cheques was returned saying it did not cover the balance, but there is no balance on the letter it was returned with.....the funny thing is the letter it was returned with looks completly different to the others.....no address at the top no barcode and more inportantly no signature.....
    please help what do i do now i'm being harrassed but they dont accept the payments when sent

    can you give me a time line for these letters

    date of each letter
    balance if any on each letter
    confirm what letters were hand delivered or sent by post
    date of any bailiff visit before and after you sent the cheque
    date you sent the cheque
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    Perhaps it might be helpful to remind those varmints of the celebrated case of Entick v. Carrington, though I fancy they might be only able to understand the celebrated retort in the matter of Arkell v. Pressdram.

    I always thought non payment of Council Tax ment court summons and possible prison sentences ?
    That may be appropriate for cases of wilful refusal to pay.

    First letter dated 28 10 2010 £303.05
    Nov 24th made payment plan of £33 per month and made first payment.
    2 march 11 made contact with bayliff to arrange payment after noticing cheques i sent had not cleared account.
    11 march made payment of £200.00
    bayliff removal 21/03/2011 £111.00 i then sent the cheque for this amount which was returned...
    letter with cheque dated 12/04/2011 no amount
    11/04/11 telephone conversation where i was advised my cheque was for the wrong amount.
    final notice advising if non payment they would hand me back to the council.....again NO AMOUNT.

    really unsure what to do council have said i can clear account with them but it will still be in the hands of the bayliff.....i jump now every time the door bell goes.
  • i think its worth stating that the letter that was returned with my cheque has a different logo, page layout and has a name (which is a first) but not signed.....and since no one there could tell me the amount owed i am curious how this woman knew what the amount was...
  • Thanks everyone for help....i have sent them an email.....however now i have had a letter stating that they have identified goods to sell......but since i have been at home all week with a sick child i would have noticed someone looking in my windows,...

    Well thaat's a complete lie then isn't it. They can't levy through a window. Have they ever been in your house? Have you got a car? Unless they have levied on the items they can't come and get them and if they have never been in your house they can't break in. They are almost certainly trying to scare you and charge excess fees. Gotta go but someone with more help and info wil be along later I'm sure.
