Section 75 - confused by trading standards advice

Hello

I am in middle of S75 complaint that has gone to ombudsman.

Trading standards have advised me to contact the supplier of the goods again to ask for refund. If I do this, I would want to say 'refund me within 7 days or I will initiate legal proceedings'. This would then conflict with trying to extract the money from my credit card company, which is being looked at by ombudsman.

Trading standards say they always advise people to write one more letter recorded delivery asking for the refund. The company has already had an email, a letter and telephone contact with my credit card company and will not budge. I am willing to give it a go but should I wait until outcome of ombudsman? Or just go for it and then if I get a result, cancel ombudsman action as I guess i will not be allowed to get refund from both sources?

can anyone advise?

    Why does it conflict?
    You can take them, to court anytime you like.
    It's not a conflict as far as I can see.
    but should I wait until outcome of ombudsman?

    That could take a while.
    Why not pursue both routes?
    Just because you write a letter does not mean you are committed to court action.

    Write the letter.
    It doesn't commit you to anything.

    Whether to actually go to court?
    Well I'd want to know first why your credit card have refused a refund before commenting further on whether it's worthwhile.
    The ombusdman is free, but even small claims has fees attached and you might have to take time offwork, so we'd need more details before commeting.
