Hi there i wonder if anyone can advise me.I am about to send in my probate forms to let me deal with my late mums estate.I am executor of her will along with my brother.I am the one who has done all the paperwork.
I am now getting conflicting advice from my brother and my sister and her husband and now i'm very confused.
I have been doing all the paperwork on my own without the need for a solcitor but because of the position i'm in my brother wants me to get proper advice before i send the probate forms in.
Basically i am a discharged bankrupt and am also on benfits as i have been very unwell,i chose to go bankrupt when i had to close my shop down because i was very ill.
I need to open up an executor account for my mums money.Will that cause me a problemif i'm a discharged bankrupt?
Also because i'm on benefits will it be ok for me to open up this executor account.I know i will loose some of my benefit when i eventually share all the money out but will opening up an executor account with my name on be ok without it affecting the benefits just yet?
Do you think i need to get a solicitor involved now?I'm worried incase i'm getting out of my depth or am i worrying unnessecarily?

You should be OK opening the executor account as far as benefits are concerned. This money is not yours, it belongs to the estate. You should make the account jointly authorised with the other executor, I would think.Hi, we’ve had to remove your signature. And make sure it is a joint signatory account, and that both persons authority are needed to sign any cheques, pay any money out or set any payments up.0 -
Thanks guys for your help and what about getting some financial help about what to do with the money?I know i'm going to be restricted because of the benefits.If i come off the benefits does that mean i cant pay any of my mortgage off or cant invest any of the money?0
