How long do you think this will take?

Long story short (silly as I just wrote it all then deleted it) I was pulling away on a slight incline which was about to get steeper in a cue of traffic after nearly stalling and I had applied my handbrake at the time. When we were hit from behind.

The third party is claiming a back seat passenger saw me roll into them which I didnt. (tho I suspect they are saying they saw me not just the 1 back seat passenger)

Is this common practise to try and wriggle out of it? My car needed a new bumper. Not the sort of damage I would expect on a roll back. Does it ever work? Am scared of having to suddenly pay my excess for an accident that isnt my fault. How long do these things normally take to sort?

Am hating this. why couldnt they just admit it like adults? I would and have. Everytime a new letter or bit of info comes through I start getting shakes in my hands again. I've been off work, my daughter started wetting the bed, its been awful and this is just compounding it :(

So any idea how long them playing silly sods will go on would be great. It happened the other week so I just put my statements and diagrams in. ta xxx

    Well their story sounds believable, but insurance companies take zero notice of witnesses from either vehicle. Independent witness statements are the only one's valid.... That or in car video (like I have in my car).

    Their insurance company will try it on, but they'll cave in eventually.

    Rear end collision, their fault, end of....

    why isn't it the sort of damage you would expect from a roll back? why would the damage be any different than if you were hit from behind?

    I'm guessing speed -- he'd have needed to have been going some (and so would have needed a fair run-up) to cause that sort of damage, which isn't usually the case if you just allow the car to roll a bit. At that point the OP would be up for careless driving.

    From what I've seen of rear-end shunts the car being rear-ended usually comes off better than the one behind -- frequently the rear car needs a new bumper/bonnet while the front escapes with little more than a couple of scratches or creases. So for the front car to be damaged I'd have thought it must have been a fair old bang.

    Have you reported this to your insurance company?

    This should be a simple case of being the other drivers fault, so I wouldn't worry about losing your ncd.

    When liability is disputed expect it to take months rather than weeks to settle.

    If you are claiming off your own insurance, then this shouldn't affect the repairs being carried out, though you will probably have to pay your excess when the repairs are done, then await the liability issue being settled before claimning it back off the third party (assuming the third party accepts full liability).

    (And people do often change their story away from the scene!)

    NCB will be removed from your policy until the matter is resolved, so if your up for renewal it could get costly.... But you'll get a payment back once the matter is cleared.
    It's a bit of a con really because your insurance company know your stuck with them and hike your premium.

    Unless the NCD is protected then some of it will be (maybe temporarily) "lost" if the OP has put in a claim to their own insurer pending the outcome of this. This can cause a "worry" should the renewal come up before the issue is resolved!

    Shoot. I never thought of it effecting my NCP in the mean time. The renewal is up in May but only for 4 months to bring it inline with DH's car (admiral multicar) So I cartainly hope its done by then. Cripes, this, my first speeding ticket AND womens insurance going up I dread what the renewal is going to be.

    I would have thought we say we didnt roll, they say we did, they cancel each other out as we were all in th car your left with damage to the back of a car and damage to the front.

    Reguarding the damage, yeah, if I had rolled back I would expect a little damage and the cars to be touching, not left 1m apart. Also if it was my fault as they claim, why not get out and say this is your fault? Why get out and say this is your fault, then its both of our faults, lets not go through the insurance company's, we'll pay for all the work to you car? Doesnt add up. Tho I guess thats for the solicitors to sort

    also beware if you were to admit you rolled back into them you would suddenly have solicitors letters on your doorstep from driver and any passenger claiming whiplash injuries.
