Lloyds TSB - Bank Account and charges

I seem to be having a long running issue with Lloyds TSB. The background is that 3 years ago, my partner and I hit slight cash flow problems. Although I was putting all available funds in to the joint Lloyds TSB account, the charges were swallowing our money and therefore making us default on our mortgage. After a couple of months of this I decided enough was enough and took management into my own personal account, after around 6 months we were relatively ok.

My issue is as follows, when I stopped using the joint account it was sitting at 517 overdrawn, with a 500 overdraft. This then spiraled to a total of 1048 owing to lloyds TSB due to charges. The charge agreement went to and fro for a while with me not getting anywhere. It was then passed to SCM solicitors, which I know is simply a subsiduary of LTSB Collections. After explaining the situation to the person I was dealing with they agreed to take the 517 in 4 payments. My last payment was November and I have now received a letter from Moorcroft (debt collection) for the remainder of the charges, even though that was not what was agreed.

I will bew contacting SCM tomorrow and asking for my case file from them to persue this in a legal manner but I am looking to see if anyone has any advice before I start tomorrow morning.

    Just refer them back to the original agreemnt - do you have a copy?
    If not tell them you are disputing the amount owed - it will be then sent back to the bank.
  • I'm by far no expert but I am dealing with a similar situation for my partner. I believe for the mostpart the charges are not entirely fair or even legal (again I'm not sure) and are refered to as 'Snowballing'

    Read the guide on the site about reclaiming bank charges, I am doing this as we speak and intend to reclaim nearly £600!

    As for moorcroft, I too have had dealings with them. Their call centre staff aren't all bad so should you get someone with half a braincell then call back and get someone else.
    And if they agree to take X amount on a set date.... WATCH IT!
    They did this to me, and took over twice the amount agreed and as a result massive fines ensued... Luckily enough on the day we saw the bank manager so all was well.

    I'm going to be requesting an entire copy of my case file from SCM, including previous communications and calls made to them (which legally they should have) on the ground of personal data protection.

    Get all of my documentation sorted out and any gaps, dispute the amount owed based on the agreement and go to court if needs be.
  • Well this one was easily remedied, they have accepted there was an agreement in-place and closed the account.

    If I was malicious I could have a field day with this situation. I am receiving very threatening letters from the debt collection agency. I wonder what grounds there would be for mental distress
