Advice needed please -Barclays Partner Finance harassement

I'm hoping some of you will have some helpful advice for me!
We paid our 1st CCCS payment yesterday and are currently waiting to hear who has or hasn't accepted our payment offers. I wrote to all our creditors in January to explain the situation and in the Barclays letter I also asked them to remove all telephone numbers and to only contact us by letter as my husband was getting over 10 calls, day and night!
They ignored it so I sent another stronger letter quoting some of the legal jargon provided by the helpful people on this forum.
They continued phoning so I wrote another going over the facts and today they have replied.
They say they didn't receive the 1st two letters (hmm not sure thats true). They state that they can't remove the numbers as we signed the original agreement which states that they can contact us should we fall into arrears. They feel it is reasonable to contact us to recover monies.
My questions are: can we still tell them to remove numbers and is 10 calls a day "reasonable"??
Any advice gratefully received

Yes they are right, it is a legal agreement that they have a contact number for you. It is not however, a legal agreement for them to call you. If you want to deal with everything by post, then that is what they should do. And any more than 1 call a day is harrasement.

If you request for your number to be removed then they are obliged under the DPA to remove it from their systems.
Have you seen this post Nik? - http://forums.moneysavingexpert.com/showpost.php?p=11571485&postcount=4 The very bottom green section clearly states that a request under the DPA supercedes any contractual provision they claim exists. I would keep on at them and send them a letter along those lines.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thanks for that Frick.
Should I write to them again stating that everything must be done in writing and not via the phone as the calls are causing my OH extreme stress. They call all through the day right up to late at night. Infact they called just as I was typing this!!
My OH is just not answering it anymore.Shellshock  or Nik now the shock has subsided!!DMP March 11Savings account opened Jan 11 £10£1 coin savings tin - £22Total Debt [STRIKE]Jan £31,519.87[/STRIKE]!!!:( March [STRIKE]£30,879[/STRIKE] April £30,202DMP Member 4020 -
It's normal to have a load of calls, even at the start of your DMP. Send the letter that Tixy posted and make sure that you send it recorded delivery (I think it costs less than £1.00, money well spent
) and keep a copy too.
It's unlikely that your creditors will not accept your DMP payments, even if they make a noise, they will still take the money and if any of them do take you to court (not necessarily as scary as it sounds) you will have proof that you have paid a regular amount and that you have sought help with your debt problems.
Things will settle down later on, it can take a couple of months though, so sit tight, tell hubby to not answer the phone, unplug it if it helps, and don't fret too much. They can't have what you haven't got and you're not alone, many of us have been through this too.
Good luck with your DMP and your debt-free journey!"I may be many things but not being indiscreet isn't one of them"0 -
Thats just the advice I needed Tixy - thank you!
Thanks for the support guys - I'm feeling a bit brighter today and ready to tackle them once again!
I will get that letter off today (recorded delivery!).
