My house has been on the market with one particular EA since July 2010, since then we have had nearly 50 viewings and only 2 offers - both offers came in at the same time and so we acepted one, only for them to pull out 4 weeks into the buying process. In the meantime we had found our dream house, had our offer accepted and had all the searches, valuations and mortgage details sorted. We have been offered a part exchange deal with our new house vendors but the offer is for little less than we wanted to lose on our house. Therefore we are wondering if we still need to pay the EA, even though they havent put us in touch with this buyer and also as our 12 week exclusive period with them is over?

I don't think you should. But it will depend on the small print of your contract. Check it. Ask them, if necessary.Act in haste, repent at leisure.
