DABS wont now give me a refund!

I received a blu ray drive for PC on 24/02/11 and decided to send it back. Dabs e-mailed me a link to get a rma returns number which now no longer works. They have been off line all weekend and now they are saying that it is too late to send back even thou their refund policy states you can return within 7 working days. All i get from them are automated e-mail replies. What can I do next as this is surely breaching the distance selling regs?

This was my first time using Dabs and if this is level of service a doubt it will be using again:eek:

    Under the DSR's, you have 7 working days beginning the day after you received the goods to inform the seller of your desire to cancel the contract, and as you actually received the drive on the 24th Feb (last Thursday), you have up until next Monday (7th March) to inform DABS of your wish to cancel.

    As already suggested, phone tomorrow and simply inform them that you wish to cancel under the DSR's as is your legal right.

    Under DSR the cancellation has to be in a "durable medium", so unless it is in their T&Cs that they will accept a phone call under DSR, then maybe that is not a good idea, plus unless you record it you will have no evidence of cancellation.

    What must my consumers do if they want to cancel?
    3.26 They must tell you in writing, or in another durable medium, if they want to cancel. This includes letter, fax or email. A phone call is not enough unless you say in your terms and conditions that you will accept cancellations by phone.

    I was assuming (maybe wrongly), that as the OP has already sent e-mails and had received a returns number, this would qualify as having informed them as required.
    I just suggested the phone call in an attempt to get the refund progressed a bit.

    Tried today but they just kept me on hold then cut me off. They just won't reply to my e-mails. They wont accept returns without a valid returns number so I can't use the original returns as the link in the e-mail they sent says page not found. This has happened since they shut down at weekend with maintenance. Just don't know what to do as the 7 days to return is running out. I will never buy from this lot again.:mad:

    Provided you have notified them by email/letter/fax within the 7 days following receipt, then you can return the item when you are able. The item itself does not have to be returned in 7 days, you simply have to notify them of the intent to return (under the provisions of the DSR).

    If they don't respond then you could send it back yourself (with appropriate packing, insurance & signature on delivery). Provided you have notified them of your intent to return withing the 7 days and you have taken reasonable care of the drive then they are obliged to issue a refund within 30 days of the receipt of the notice to cancel the order/return goods. They cannot insist on the need to RMA etc to return the goods in accordance with your statutory rights (although it may make the process easier).

    I would write again by recorded next day delivery. You are entitled to your money back. Don't be fobbed off. Here is the bit from Consumer Direct:

    Dabs customer service went down hill when BT took them over a few years back. I used to use them all the time, haven't used them for ages now.

    As per the advice above, I'd give them one last go tomorrow, failing that send it back anyway. Don't forget you are entitled to the full costs plus the delivery fee back, but not your costs in returning it.

    Still not sorted. CS is non-existant with absolutely NO phone support at all. :(

    Anyone thinking of buying from this shower...please take my advise...DONT!

    Still no refund from the 'Bolton Cowboys' aka Dabs. Avoid this company like the plague!:eek:
