Sunshine, I have to apologise, you are absolutely correct and I shocked in myself for being so naive. I was labouring under false and erroneous advice I had received from HMRC.

Why am I not surprised in the slightest to read this? *sigh*

I know, as sad as it might seem, I was caught on a bad day. HMRC have accepted their mistake and will be refunding the money forthwith. From that perspective they have to be commended.
The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark

Thanks for posting that Flyboy and sorry you have lost out.

If you could prove you relied on advice from HMRC directly and have lost because of that then you could file a complaint to try and achieve compensation / goodwill payment. Its hard work and long winded but can be done

I know many think accountants just drum up business but as people who deal with HMRC far too often for my likeing, we do know how bad some of the "advice" given by their phone operators can be. So many tax payers must pay the overall wrong amount of tax or receive the wrong amount of tax credits each year its frightening

!!!!!! are you blithering on about. Self-employed income is flip all to do with the context of this discussion. You really do have rod up your end don't you, when it comes to being challenged.

Self employed has EVERYTHING to do with proving what you said was wrong because the income for tax and benefits is worked out as income less tax deductible expenses, the same way as PAYE gross income can have tax deductible expenses, such as expenses in employment deducted and, especially in the case of lorry drivers, some none taxable payments are not included such as subsistence allowances.

Likewise with renting a property out, the income from that is rent minus expenses the same as any other business.

It would appear you realise you've had very poor advice, in fact advice from someone who is no better than Bob down the Dog and Duck but has the audacity to charge for said "advice". If you can't find someone who is worth a toss, I can strongly recommend a family friend who knows the tax system inside out and offers a complete book-keeping and payroll service as well as forensic accounting. She also will testify on behalf of a client at a HMRC investigation etc and in many cases, she saves her clients £1000's in tax.
