DLC debt collectors - do I have to pay now

I asked for a copy of the credit agreement for a flexiloan I had with HSBC and they have sent me a copy of the flexiloan account statements but nothing with any signature or actual agreement.

They now say failure to contact within 7 days will result in "further action".

Do I have to start paying the debt back or does anyone know what my next step should be?

    When you say you asked for a copy of the credit agreement do you mean you wrote them a letter to ask for it and enclosed the £1 fee?

    What reason are you not paying at the moment? How long since you last paid towards the debt?

    Yes I gave them the £1 postal order and made the request, I recieved a letter back on the 8th of Fe saying they recieved it and would be in touch shortly.

    Please bear with me here, the story behind this debt is a long one!
    I had PPi with the flexiloan and when I was still paying the loan and PPI every month I wanted to claim on the PPI as I was signed of work with depression.
    I contacted every dept in HSBC I could, went to the branch (they told me they couldnt help me), and was given various numbers and companies to contact who the HSBC advisors told me underwrote and dealt with the insurance. When I contacted the companies they told me they did not handle HSBC PPI policies so this went round in circles till I could no longer make payments and the loan went to a DCA.
    I have sent a SAR to HSBC Insurance dept with £10 PO to try and get the insurance details back.

    The reason I have made no payments since March 2009 is that I feel I was essentially conned when I took the PPI out whcih would have covered the loan repayments but HSBC just fobbed me off.
    It may sound daft but I wanted and have been trying to raise the issue with HSBC in the hopes of getting the debt written off or at least an explanation as to why I was given such a runaround

    The 'further action' phrase is suitably vague to suit their purposes.

    If you sent a formal request and they haven't sent you the paperwork then the further action cannot be court action but they could take other action such issue a default to your credit file (if they haven't already) or continue to report to your credit file. They could simply mean they will pass it to their inhouse collections department or in house debt collectors to deal with from now on.

    You could write to again to point out that the items you have received are not the consumer credit agreement that you requested and could they please supply it. (The agreement they send doesn't need to have your signature though).

    Good luck with sorting out the insurance side. I doubt you will get the debt written off but hopefully they can resolve the insurance side to your satisfaction in terms of agreeing to pay your repayments for the 12months or so or getting the PPI reclaimed.

    It has already been recorded as a default and as childish as it is I grudge starting repayments when the PPI would have covered it :(
