Paypal seller keeping fee after refund

Hi everyone, any help is greatly appreciated.

I made a purchase through paypal and was not contacted about the order. When I contacted the "company" they told me that the item is not available. It is now coming up to 55 days.

I requested a refund and they agreed to pay back the money by cheque minus the paypal transaction fee. They refuse to pay back the money through paypal, if they did they would be refunded the transaction fee and would not have to charge me this.

They say it is in the terms and conditions but if I paid by paypal I don't see why I can't be refunded that way.

Why would you want to punish your customer unnecessarily?

Does anyone know if this is allowed or if there's any action I can take, just seems like a scam.

    No, it's not allowed.

    Contact paypal directly and see if you can get a refund via them.

    After 45 days you lose any ability to claim via paypal, so you are in a tricky position.

    You can either sue them for the money or accept the cheque.

    How much is the fee? For a few quid, I'd just accept and not use them again

  • Thanks guys, it's a £20 fee they say from a £600 purchase. I thought it was 60 days with paypal. They didn't get in touch to say it was unavailable they waited until I contacted them.

    Actually i would grab the cheque as fast as you can, there is a very good chance here of you being scammed and getting nothing back.

    I would accept the cheque, then send them a "letter before action" saying that unless they pay the additional £20 in the next 14 days, you'll take them to court for it, as they are not permitted to retain such a fee.
    Should've = Should HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
