I think you need to quote the exact wording, because with that clause you have a claim for some bits of paper that have no value so no loss.0 -
I would personally try the Small Claims Court. Your costs are limited to around £100, so if you can afford that, then you only have that to lose and potentially £3,000 to gain. It will also give you the satisfaction of causing your buyer to defend the claim.
Some of the other posters might be correct in that it needs to be part of the main contract, however, I am not sure if the the questionnaire that seller have to fill in about problem neighbours is part of the main contract and I would have thought you could take someone to court if they didn't answer that truthfully.0 -
What has it got to do with the seller what the buyer does with the house after completion?
What actual loss have you incurred due to the roof not being repaired?

One week from completion? Sounds like the contracts had already been exchanged by that late stage.
Had a sale price already been agreed and contracts exchanged when he threatened to pull out if the price was not dropped?
If so, I would question your solicitor as to why they gave you such rubbish advice of agreeing to drop the price instead of pointing out to you his price was legally binding.0 -
Think OP needs to clarify is contracts had been exchanged or not before the clause was added.
If they had the OP's sols would surely have told the buyers where to get off!
If they hadnt, I think the OP is wasting their time claiming for a non existant financial loss, ie they are 3 grand down whether the roof is mended or not/paperwork supplied or not!I am a Mortgage Adviser
