Ending Tenancy? Two Months Notice? Really??

Quick question - which has been asked a million times before I'm sure. :D

We've had an offer accepted on a house and have been trying to figure out when we need to give notice on our rented place. I asked our solicitor, if we really have to give two months notice then we'll need to have six weeks between exchange and completion.

We were on a AST until Oct 2006 with a letting agency, when we asked if we could go on to a rolling contract.

This was accepted and we have a letter saying that the landlord and we (the tenants) also need to give two months. We didn't sign anything.

Surely because we didn't sign anything this means we're on a monthly periodic tenancy and only need to give one monthnotice?

Essentially can we quote the Section 21 of the 1988 Housing Act and tell them to sod off with their two months notice?
Or does the letter stating the two months notice over ride it?

Six weeks between exchange and completion doesn't particularly bother us, but might upset the vendor.

  • Yep, one month's notice IN WRITING. Please double-check the dates on your original agreement so you're absolutely certain that you give notice to leave by the right date. Get it one day wrong and you could be liable for another month's rent.
  • Although it would need to conincide with a rental period, so if that is coming up soon get that letter of notice in ASAP.
