Housing Association

I have recently been dealing with the affairs of my late mothers estate.
She lived in a housing association property but had some savings.
I have no objection to paying any outstanding rent but I am concerned that the Housing association may wish to charge me for the removal of carpets and curtains.
The keys were handed back recently and the house was spotless. We left the carpets and curtains for the benefit of the next tenant.
Do they have any legal right to charge?

  • The short answer is "yes", but they also have discretion. Why not get in touch with them and discuss the matter.
  • Our Local Authority is encouraging tenants who vacate to leave carpets and curtains if in good condition. THey are realising that a lot of young couples are unable to afford the outlay and some have to live without.

    Yes they have the right to charge - however they only have the right to charge the Estate and not family members.

    As WWH has said, the officer may have discretion - but they may need to inspect the carpets. Give them a ring and ask the question.

    They most probably can make a charge to the estate, depending on the terms of your late mother's tenancy.

    Did you speak to the HA before you returned the keys? e.g. to advise them of your mother's passing and to ask what you needed to do etc? If you did and they charge you for removal of carpets/curtains I'd appeal and make a complaint that you were not advised to remove them.
