    The same argument goes for you regarding your excess.

    If you pursue the third party for this (plus any other uninsured losses you have incurred) and win, then it will follow that your insurer will be able to recoup their outlay and reinstate your NCD.

    This can be a great problem, I can recall seeing one case in a newspaper where, because of the timing, it affected two years worth of premiums. Not sure what the solution is but it seems tome very poor when the policy holder is effectively held to ransom. They can't go elsewhere as they are in limbo...

    You don't have to remain with the present insurer just because there is an unresolved claim.

    It is a regular occurrence that policies expire with ongoing unresolved claims.

    Explain the situation to your chosen insurer before taking out a new policy, and get them to agree (in writing) that if the NCD is reinstated they will adjust the premium from inception date and will refund any premium reduction to reflect the corrected NCD.
