Only 3 companies out of 9 have got back,Do I re-write Offers/SOA?

Hi all, I have a thread under “In debt big time/Help wanted”, Just want some advice on this please. I’m worried as only 3 companies have got back to me say they will reduce payments & have set up a standing order to them each month, all the others are still sending me statements & telling me I’m in arrears even though the Offers/SOA letters were sent over 4 weeks ago. Should I re-send to those who haven’t got back or wait still ?, Have proof of sending to each company as I done all Recorded Delivery.

    out of 10 companies( husbands as well) we only got one reply.
    I just set up the token payments anyway as we could not afford to pay more then that no matter what they had to say about it really.

  • It’s a little worrying as they say in some letters that they may pass this on to there debt department or a collection agency but I have held my hands up to each of them & want to start making small payments.

    4 have gone to debt collection and to be honest so far I have found them slightly easier to deal with.

    Problem is that they don't have to accept anyway and some just don't

    We had this problem too. It really frustrated me, not knowing, we drew up a 'hit-list' of creditors to make contact with. We rang them all and got a lot more info over the phone - people like Mint simply hadn't bothered replying but told me verbally that they'd accepted it all and wished me luck etc, explained that they'd continue sending fairly irrelevant paperwork and just to ignore it and let the wheels grind on. Eventually we got a letter from them.

    This was the same for most of them and, on the phone, they were really pleasant. It worked for us as it made everything clearer.

    The only sticking point on this have been Barclaycard and MBNA.

    So, I'd say worth ringing - we simply asked:

    Just checking that you've received our / CCCS's letters.
    Can you tell me if you have accepted the payment plan?
    Are you going to send a letter regarding this?

    Also, make sure you have any ref codes handy (such as CCCS ref), contact phone numbers etc. Also, get the name and direct number of any creditor person you speak to and record this on your spreadsheet (if you're doing one).
  • Quick up date, Lloyds Tsb credit card got back today with a letter saying I can make the offer payments for a while & Virgin credit card have charged me £12.00 for Unpaid Direct Debit,£12 Late Payment Default Sum & Interest at £22.23.

    Have now set up standing orders with the credit card companies even though only half got back to me, I’ve set up the amount I can afford each month even though Halifax, MBNA & Virgin didn't get back to me & still billing me even though I sent them offers around 5 weeks ago, hope this is ok as it's a "Token" offering :embarasse.
    Not sure how to go about the Overdraft & Loan with HSBC though:undecided

    You are right to start making your reduced payments to all - dont wait for them to agree - you are telling them what you can afford, its not a request, its a polite notification. They will start to communicate when you realise they are not getting the minimum amount. If you havent already, ask for interest and any charges to be stopped so you are actually hitting the debt and not just treading water. (I used to say, if you freeze interest etc, it will take my x months to pay you at y money....:) )

    If you are not making the minimum payments you will be defaulted (trashing your credit record) and the debt passed to a debt collection agency. It just means you pay someone else, no biggie - honest :) And in my experience its easier to get the interest and charges stopped with a debt collection agency.

    Edited to add- if you bank with HSBC, move your wages/income BEFORE you default on their loan etc. Or they will offset your wages against the monies owed to them first.

    :(Great:(, phone call from MBNA who were ringing me about missed payments on my Virgin Credit Card, told them I sent letters off with the SOA & who I own money to. Not really helpful & said the debt will be passed on to the Debt Management team, he did ask what I could afford & I told him the same amount I offered others, he then said “No we wont except that” & interest will still be building up on both my MBNA & Virgin Credit Cards, I did explain that other companies were more understanding & froze interest & will review the situation in 6 months:A, he than said “That’s not are policy & we don’t do this”.:mad:
    I have tried & I did set up a Standing Order 2 days ago with both to pay a token payment.

    Don't worry about the phonecalls - you're better ignoring them actually.

    The creditors who haven't bothered repling to you, if you haven't called them - maybe just send a letter to them saying "I write in regards to my letter of xx/xx/xxxx and note that I have not yet received a reply. I therefore write to confirm that a standing order has been created to pay you the sum of £x on the xxth of every month. These payments will continue until such time my financial circumstances change."....or something like that.

    I set up payments with 3 DCA (Equidebt, Lowell, Wescot) and all replied very quickly.

    Hope you get it all sorted soon.

    Honestly, don't worry they do this. MBNA told us categorically that they wouldn't accept the DMP and wouldn't stop %. It was passed on to the Debt Management Team, who immediately stopped the % and default charges. We still haven't had acceptance or refusal of the DMP from them but they are accepting the CCCS payment and aren't charging %. The debt management lot tend to be better than customer services.
