Help!!!

Just had my beloved golf gti stollen and im going thro an agonising wait until more than contacts me.
I was totally unaware that i have got to tell them i got 3 points last April for going through a speed camera, my insurance was renewed in october, i just didnt read the small print.

can someone tell me is my insurance void because i didnt declare my 3 points? even though my car was stollen and not involved in a crash where speeding may be a factor?

im going through hell at the mo :(

    have a read of http://www.financial-ombudsman.org.uk/publications/ombudsman-news/27/27-ins-nondisclosure.htm

it should help you frame your argument if you get questioned
  • thanks Viao

that article has given me a bit of hope.

My 3 points were last April and i kept to the same insurer and just didnt realise that i have to declare points(never had points before in driving for over 20 yrs)

im awaiting a reply from More Than but i am preparing my self for the worse outcome, but ill appeal there decision based on the facts that it was a simple oversight by me, my 3 points are for speeding and are not in connection to the claim with it being theft, and my policy just continued which isnt like non declaring with a new insurance company.

Hopefully i might get some sleep tonight

    thanks

Do you or any other drivers (on the policy) have any other convictions or claims ?
  • the wife is on as a named driver, and has got a clean licence.

what are my chances of winning an appeal if they dont pay out?

You should be ok under the "Inadvertent" non disclosure, you'll probably have to pay the loading you should have which with More Than could be circa 25% of your premium. Make sure you inform them of the conviction, allow them to go through their non disclosure process and you should find that it sorts itself out.

Make sure you are totally truthful with them at all times when dealing with the claim

I would bet my house on it that you will be OK.

The way insurance companies look upon these situations is would they have provided cover if the points were disclosed, answer to 3 points for speeding is yes they would so you will be covered.

If it was say a drink driving conviction or driving without insurance then that would be different as they may have refused cover but for 3 points for speeding, that won't be an issue.

I had a friend who just wrote their car off, did not disclose 6 points and they still got paid out so try not to worry.
  • Thanks for the reassurance all, I'll keep this thread running an feedback there reply and any actions I may or may not have to take.
I've been with More Than since I purchased the car new (3 yrs)
So hopefully they will see it as I've overlooked it.
    Thanks all!!

It is worth mentioning, some insurers request they be informed IMMEDIATELY of any conviction. Others only on renewal. Carefully read your policy documentation so you know your obligations in this situation.
