Significantly Not as Described

Thanks for all constructive advice.

1. Item was a medium size electrical item.
2. Seller described it as in excellent working condition.
3. Item arrived and does not work at all.

Emailed seller and asked for refund mentioned i would return item to them. Simple email by return saying item was working when it left them and therefore it must have been damaged in transit. No further contact.

Have started a paypal dispute citing item SNAD. Paypal escalated it within an hour or so to a claim.

I know I have to send the item back to the seller. Do I wait till paypal tell me too?

I arranged a courier collection/delivery (to me) does this change anything? (Seller listed it as buyer collect but I sought and got agreement for a courier collection).

Once I have returned the item and have the tracking information required is it an automatic refund? I ask as I think paypal is new to the seller as she had problems retrieving the funds I initially sent.
How do paypal grab the funds back from the seller and will I have problems if they cannot?

End of the day we are talking about a <£75 item but if my chances are remote of getting a refund are negligible (there are many horror stories about paypal) why go through the rigmarole of returning it.

I used My Hermes as the courier company and insured the item up to £100. I have lodged a claim through them so will need to see how that progresses before I take the next step.

  • This is a classic reason why a seller should not allow a buyer to arrange collection/delivery.

    When you return the item, you will have to upload the details to the claim. As long as the tracking says delivered/attempted or refused, the claim will go in your favour.

    In normal circumstances the seller would claim from the carrier, but on this occasion they cannot.

    My Hermes is one of the worst carriers IMHO.

    If you manage to reclaim from them, then you have a moral duty to send the money to the seller as they wil lose the paypal funds, have a broken item and no redress.

    I fully intend to play fair. All I ever wanted was a working item. The seller agreed to allow collection in good faith so I will ensure a level playing field on resolution.
  • You may wish to let them know this. Clearly they are not eBay savvy.

    I wish you luck with My Hermes. You will NOT get a resolution from them before your time clock runs out on your dispute. So you may have to complete the dispute and then wait for your claim from MH.
