  • Just want to help - you are quite correct, it was the Ombudsmans office that signposted me to TPAS. The gentleman that helped me was retired and located in another city. I signed some authorisation/consent papers and he did the rest. He was fantastic - and I duly wrote and told him so afterwards :)
    Thanks for that reminder, I had quite forgotten about them - is it any wonder on 20+ meds daily :(
    Hope that is an extra little help for you dialysis if need be.

    sounds like we all seem to be struggling with nhs pension. i to have been declined again and i am about to make my final appeal. i have fibromyalgia, the rcn will no longer support me so i am on my own. i;m hoping my consultant will fight my corner.
    As regarding debt, already on a debt managemnt plan and i've just lost £400 a month ESA, i am appealing that as well.
    get fed up with fighting all the time
    if anybody has any advice please let me know

    I am so sorry to hear this. Unfortunately, this is not about people "fighting your corner" even if they're health professionals. Your diagnosis has to match the criteria set out in the NHS pension scheme rules. Do you know what this is? For many schemes, you have to be permanently incapable of any paid work of any kind at all. In pension circles, the analogy is often "can the brain surgeon sweep the roads? If so, then he/she doesn't qualify for an ill health pension.

    What reasons have you been given for refusal?
    Warning ..... I'm a peri-menopausal axe-wielding maniac ;)
  • It seems to me that you have to exhaust all internal appeals and then go to the ombudsman. In my experience, ATOS turn down all applications and appeals. ATOS do the assesments for EESA and DLA too, i receive mobility at the higher rate and EESA where i was put straight into the support group (as assesed by ATOS) but have been rejected twice now with my NHS pension despite having strong evidence from my GP, two consultants and a professor of cardiology. ATOS believe that i will make a miraculous recovery from an incurable disease, plus i have had 3 heart attacks in the last 12 months. My consultant has written to ATOS explaining that i am at the end of the line as far as treatment goes. ATOS's remit must be to reject all applications until the ombudsman gets involved, unfortunately this can take a year at least and more than likely 2 years to resolve, in the meantime you have to do your best to survive and put your life on hold as you cannot make plans for the future not knowing if or what income you may or may not have.
    Patience is a virtue as there is nothing that you can do to speed up the process.
  • Hi Oscar,

    If you haven't already done so, contact the Pensions advisory service the details of which came with your NHS pensions refusal. I was turned down for the third and final time for level 2 (I was already on level 1 after a fight) last year, so was ready to go to the Ombudsman. The man helping me from the pensions advisory wrote to NHS pensions pointing out some discrepancy's. They asked ATOS to re look at it and the upshot was I was awarded level 2 late last year, sure made Christmas a lot better. They really do know their business.

    The NHS 1995 scheme has a normal retirement age of 60, until we all switch over to the new scheme in 2015.

    The first part of this is correct, you have to meet the scheme requirements, which would normally be that you are permanently incapable of work. The permanently is normally the hard part to qualify for. The second statement is quite wrong though, you should be permanently incapable of working in a role that does not pay substantially less. Substantially less is a discretionary term, but it certainly doesn't require surgeons to take on manual labour.
