Iva accepted

Well our iva was accepted as of 18th feb with 25 modifications, which were mainly just the same but worded different.
They kept our expenditure and monthly payment the same so all in all a huge weight has been lifted :)

I wanted to thank you guys as you have been a big help when i was crawling the walls with worry.......

I know the creditors can't touch us now but we did get a letter today from capital one its saying that we have broken the credit agreement etc etc then says no sum of money is required to be paid under this notice, the company will participate in any dividend paid by the insolvency practitioner.

then under that

You should be aware that if we take you to court and get a judgement against you to pay us the money you owe us under this agreement you have to pay us both the amount of the judgement and interest under the agreement on all sums owed by you at the date of the judgement until the whole amount is paid. you may still have a further sum to pay.

then

the company will not take you to court to get a judgement against you for the amount you owe under the agreement whilst the iva is in place.

So does this mean when the iva is finished they can take us to court??

  • no -- don't worry -- it means that if you fail the IVA they will then pursue you ... as will all the others ... unless you enter a different debt solution. It's a computer / drone generated letter, you can either pass it to your IP or file it under "W"
