    No thats the 50+ element where you can only recieve it for the first 12 months, ive never seen a time limit on the disability element.

    There is a time limit for incapacity and the disabled element of working tax credit but on the 2nd claim you can claim the disabled element of working tax credit if you have received the disabled element of working tax credit in the last 3 months so no real change in the award at all.

And don't feel they are disabled or at a disadvantage to get a job. That for the rest of their lives they can claim the disabled part of WTC?

    That's how it reads to me also, but I'm guessing it maybe only applies to the second year, and Jen assumes we've worked that out for ourselves?

    I'm looking into get back to work, after an extended period of absence due to illness/disability, and finding the whole tax credit thing a minefield. :o

    Am I right in thinking, that as long as I receive DLA, and, therefor, obviously satisfy the conditions, that I'll be eligible for WTC - if applicable to my earnings?

    My head hurts thinking about it all. :( Was much easier when I was able to just go out to work and earn what I needed to survive, and did 30 hours a week overtime to keep me in the lifestyle I wanted to be accustomed to. :rotfl:

    ETA: I'm sure that is what Jen's saying. She said there's a time limit on IB and disability claims of WTC, however on the second year...

    Even still, it seems a bit weird/generous that they'd allow an [ex] IB claimant to claim the disability element of tax credits for a further year.

    I can see that changing...

    I read it that you must have one of the qualifying and you WILL get it
    A claimant satisfies the qualifying benefit test for the disability element if
    • They are getting one of the benefits below
    • Disability Living Allowance
    • Attendance Allowance
    • War Disablement Pension (which includes Constant Attendance Allowance or a Mobility Supplement )
    • Industrial Injuries Disablement Benefit (which includes Constant Attendance Allowance or a Mobility Supplement)
    • An invalid carriage or other vehicle provided under the Invalid Vehicle Scheme
    Or
    • They are currently receiving one of the following benefits, or have been receiving one of the following benefits in the last 26 weeks before the date the claim was received
    • Short Term Incapacity Benefit at the higher rate or long-term Incapacity Benefit
    • Severe Disablement Allowance
    • Income Support which includes a disability premium or a higher pensioner premium
    • Jobseeker's Allowance – income based, which includes a disability premium or a higher pensioner premium
    • Employment and Support Allowance (ESA) which they have received for 28 weeks or more or where they have received Statutory Sick Pay (SSP) followed by ESA for a combined period of 28 weeks or more
    Note: The 28 weeks does not need to be a single continuous period. You can add together any periods that the claimant has received ESA as long as the periods were no more than 12 weeks apart. You can add together any periods that the claimant received SSP as long as the periods were no more than 8 weeks apart. You can add together any periods that the claimant received SSP with periods that they received ESA as long as the periods were no more than 12 weeks apart
    • Housing Benefit, which includes a disability premium or a higher pensioner premium
    • Council Tax Benefit, which includes a disability premium or a higher pensioner premium
    Or
    • They are applying through the Working Tax Credit Fast-Track and satisfy the Fast - Track conditions

    This is no time limit for the disabled element, each case is decided on its own individual circumstances, TCO decide if you qualify and now constantly check awards to see if they still qualify, but there is and has never been a set time limit to how long you can recieve the disability element, as with disabilities conditions vary and change for the better or for worse therefore there is no specific time limit.
