Volkswagen witholding some money for a deposit that should be returned?

    Agreed, and it would be interesting to know what the dealer would have done had that been the case.

    Had they wanted to deduct £100 or more, I would be complaining as vocally as others on this thread.

    I just think the OP has had some value for the £51.

    Others disagree, but it's not a situation where there is a right or wrong answer.

    It's not a matter of value, it is about what was or was not agreed at the outset. If the dealer wanted to make the transaction subject to auction, he should have agreed that, in writing, with the OP.

    Not having any experience in motability, what flyboy is saying sounds perfectly correct to me.

    However, arguing over £51 is very silly for the dealer and (possibly (see below)) the buyer.

    The 51 could have been worse, but the fact is it wasn't.

    I would say the buyer also (morally) should have known they were too late to apply. But depending on the motability procedures, which -from flyboy- seem to have safeguards built in to avoid this situation, it would appear that 95% of the blame is on the dealer's part.


    What would I do? Well I think, all things considered, I would complain and ask for the full 1000. And appeal to motability if such a thing is possible.
    Why? Because -apparently according to flyboy- there are procedures/training/safeguards in place to stop this from happening. And even if I was able to absorb £51 as a reasonable cost/loss for selling my car, other people in receipt of benefits may not be able to afford this loss, and having now lost their car may find it very difficult to get another car to replace it with. So if a retailer is not doing the procedure correctly they need to be corrected.

    My posts have been sincere, but I'm struggling to take this one seriously.

    The OP needs to work out the priorities in his life and move on.

    my priorites???... £50 may not seem like alot to some people but its alot to me. And my priority is now to find a car that already has ajustments, as i am now an amputee i dont have the freedom just to buy any car, and seeing as VW's incompotent staff didnt order the correct car in the 1st place which caused me to miss the deadline......

    Flyboy i would like to thank you for your advice, you seem to know alot about motability :)

    I emailed the salesman back and said i was not told at the time should the car not meet the 2500 i would have to repay the money if for any reason the sale should not be completed, may i add the final amount was not £51 it still had to have fees added on from auction. VW have now refunded the full amount after speaking with the manager.... good news, however i am now left without a car until next december :(

    Is it possible to be re-asessed early for DLA? I would imagine that your limb has very little chance of growing back ;) and would therefore be still eligible for DLA.

    Ive written a letter to them asking if they will review only the mobility element of my DLA... you would think they'd have a bit common sense and see that mobility isnt going to improve... im pretty sure im not going to grow a leg back :p fingers crossed!
