Question about Banks

A friend needs copies of her bank statements from last year for a court hearing (against her bank). The judge has given her three weeks to produce a couple of statements, but her bank has refused to supply them to her.


My question is:

Does anybody know whether a bank can refuse to give you a statement to your own bank accounts?

  • She said that when she looked online it doesn't go back far enough. She needs Jan/Feb 2010.

    When you say this, please could you clarify as it is not clear.

    Have you asked them in writing for statements, and authorised them to charge you for obtianing them? (if copy statements are chargeable with the bank in question)

    Have you requested a Subject Access Request?

    Her bank is accusing her of cashing a cheque. She has provided some statements (as evidence in court) from around that time, but the judge has asked her to produce a certain statement.

    She provided a written request, but was referred to speak to a certain person in Head Office. This person in the Head Office has refused to supply the statement to my friend, so my friend has applied for a Court Order. However the court order could apparently take upto two weeks & the sooner she can get the statements the better. She is assuming that even if she gets the court order, then the banks will just deliberately delay proceedings beyond the final date for her to submit.

    But I was wondering if a bank has a right to refuse you a copy of your own bank statement?

    I know that they will charge for copies of old statements, but my friend is fine with paying whatever they charge, just so long as she can get the statement she needs.

    All she should need to do, is send a Subject Access Request, quoting the Data Protection Act 1998, with a cheque or postal order to whatever the organisation is called. They have 40 days to comply with the request, before it can be taken to the ICO (Information Commissioner). A SAR is the only statutory power one can use, to compel an organisation to hand over a copy of your personal data.

    No, but they can charge for replacement statements.

    It's also possible that statements on closed accounts will take longer to obtain.

    You really need to know the exact reason the request has been declined. If she's got a solicitor I'd suggest a strongly worded legal threat would be appropriate.

    I will relay that information about a SAR, if that fails then she will have to go through a solicitor & then see what happens.

    If the bank were to ignore or delay compliance with a court order to produce a statement, the judge is likely to issue an order of contempt against the bank.
  • Why did the Judge not order the bank to produce?
  • if bank won't do it, a court order should get it out of them
