"You may get contribution-based Employment and Support Allowance if you have paid or been credited with enough class 1 or class 2 National Insurance contributions in the last three tax years ie y/e 2009, 2008, 2007."

Hi,
Your ESA contribution claim is based on your national insurance over 2 complete tax years prior to your year of claim so any claims made in this year(2011) will be based on 2008/2009 & 2009/2010 you need 50 contributions for both tax years to qualify or a combination of credits and paid contributions for both years to qualify. To qualify for means tested ESA that is based on your income and capital and not on any contributions etc.0 -
Thanks for your help and today I telephoned the NI office.
As I was 60 when I stopped working I have been getting the equivelent of Class One contributions since. This is because of age and would keep going until I am 65.
My next call was a telephone application for ESA which was OK based on my circumstances.0 -
An update.
I have been turned down.
The credits are called auto credits and do not, and have not, counted towards my ESA claim.
I wish they would of told me that, when I asked this very question on my two calls into the Job Cetre, my two calls to CAB, my call to the NI Office or my call to the benefits helpline all from the outset.
Yes I wish someone had told me before the vast amount of stress and telephone calls, sending in extra documents, telephoning through aditional information, seeing my GP for a unfit note and getting 75% of the way through the medical form.
By the way I was three weeks short of Class Two which were costing me £2.40 per week. £8.20 short when I have lived off savings for three years
