Pauls Boutique returns

That's an idea, maybe stop them robbing folk in the future.0

Indeed the principle is important.
It will cost you £30 to start the small claims process.
You'll get that back [STRIKE]if[/STRIKE] when you win though.
I imagine the court will not be that impressed with you bringing the case through principles.
I'm not sure that is entirely true because the small claims procedure was put in place for exactly these sorts of situations.
If it is true then it is sad to think that the very people who should be most interested in upholding legal principles are not:("there are some persons in this World who, unable to give better proof of being wise, take a strange delight in showing what they think they have sagaciously read in mankind by uncharitable suspicions of them"(Herman Melville)0 -
I would assume the courts are more concerned with facts and upholding the law than the motivation behind bringing a case.0

Indeed. They are BREAKING THE LAW, and will be conning others out of monies owed to them. This is exactly what the small claims court is about. PLEASE don't give up here. You have shown them the legal documents, and they are refusing to abide by them.
"your reason for return was not of our fault"
You might want to buy them a book on grammar with your refunded postageOne important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0 -
Hi Folks.
I sent one last Email informing them that if I hadn't received the refund by the time the 30 days they are allowed was up, then I would be starting Legal procedings.
I contacted consumer direct and explained my issue to them, they replied, instructing me how to progress my claim as we have already discussed but also said they would pass the information on to Trading Standards.
Whether they (Trading Standards) contacted Pauls Boutique or not, I don't know, but I found a credit of £4.95 on my card statement!
