Hi all,
I am about to leave one employer to go to another. In looking over my documentation I have discovered that I was entitled to claim the cost of my internet at home as an expense every month, however I have not ever done so, as I didn't not realise that I could.
Now, I have put in the expenses claim backdated to the start of my employment (16 months) and it has been refused saying that they would not back-date the claim, they would only pay for this month.
I have been advised that I would likely succeed at Small-Claims Court.
Does anyone here have any opinion / advice on the matter?
Thanks,
M.

Many employers have expenses deadlines, which may also be part of your contract. Whether this offends employment law or not. I do not know.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0

I have no stated deadline, and I am informed that as the claim could have been made on a regular monthly basis it is treated differently than a one-off item that I had simply forgotten about.I am an Independent Financial AdviserYou should note that this site doesn't check my status as an Independent Financial Adviser, so you need to take my word for it. If there is no stated deadline then how often were expenses claimed - weekly, monthly or quarterly? If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0

I'd get some proper advice from someone who can have a look at your employee handbook and your contract before advising you... I'd say 16 months is quite a lot, we can only claim 3 months back unless there are exceptional circumstances...
Another factor is whether or not you signed anything to say you knew you could claim the expenses or not, or if it was in your employee handbook which you were given etc... So many people never read their employee handbook and yet normally all these things are in there...DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

My former employer operated a similar policy, quarterly claims originally, then monthly claims and late claims would only be allowed in exceptional circumstances. If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0
