Can anyone advise me on how to deal with a company called Ruthbridge Ltd. They have been sending me letters and calling my house demanding payment of what they claim is an outstanding debt from from around 2002/2003. They say the debt is from a credit agreement for a car that a had but could not keep up the payments for. I handed the car back and was told that the agreement would be cancelled. Please help me!!

I would suggest you don't talk to them on the phone and that you respond to their letter by writing to them with a prove it letter asking for proof of the debt. http://forums.moneysavingexpert.com/showpost.php?p=11570893&postcount=2

Have there been 6 years since you would have last acknowledged in writing or made a payment towards this?

If so, then info and letters in this link: https://forums.moneysavingexpert.com/discussion/2606811

If necessary, combining with the letter in Tixy's post to dispute the debt as well.

    If it's 2003, it's firmly Statute Barred.

Therefore, Ruthbridge (who are notorious for pursuing Statute Barred debts) can take a running jump - they can threaten, but they cannot 'do'.

You don't have to pay them a penny, and nor should you.

If it was a secured debt are you sure its SB after 6years Fermi? I don't think the national debtline factsheet says it is clearly and I'm never sure if it would actually be 12years like a mortgage shortfall?

Yes. I'm sure. As sure as I can be anyway.

The 12 years applies to debts secured on land or property. i.e. specifically land or brick and mortar.

Debts secured on commercial goods, including cars, fall under the 6 years.

I had an email from NDL a few years ago confirming that, and can't say I've ever seen anything to suggest that it's wrong.

As said, from reading the legislation and emails from NDL, that is the conclusion I've come to.

Obviously, anyone actually dealing with this should seek their own advice to confirm the above.

  • Hi All!

I'm new to this forum and so apologies if i'm posting wrongly as i'm quite aware on what i'm gonna be posting has already been discussed, however, i'm still at a loss .... please help!.

Today i received a letter from Ruthbridge Limited where they state that they are attempting to contact the above named person (me), they ask to contact their offices immediately quoting a reference number and further information can be provided.

After re-searching this company on the internet, i know they are a debt collecter and i know it will be to do with my debt from 2004.

Could someone please advise me my next step, if i dont reply to this letter, will they arrange an agent to call me?, will they keep pursuing me until i agree to this debt? or if i ignore them, do they eventually stop? (i'm hoping the latter!)

    Thanks everyone xx
