PPI Claim through Claims Advisory Group

Options
Hi folks,

I have a query I am wondering if you could help me with regarding asisstance from Claims Advisory on reclaiming PPI.

The company I was claiming against was Welcome finance. I had sent about 4/5 letters to Welcome requesting my PPI be refunded but it fell on deaf ears. I then contacted Claims Advisory who apparently started working on my behalf. I had continual requests from them for "additional information" which I kept sending back then was going back to square one with waiting on them actually processing the claim.

Meanwhile I had a direct communciation from Welcome finance apologising for not previously honouring the payment, that they were making me an offer and also giving an additional £100 goodwill gesture as they hadnt accepted the claim at the initial time of applying for the refund. I accepted the offer from Welcome and received a direct cheque from Welcome for the agreed amount.

During this the Claims Advisory made contact with Welcome and Welcome advised that an agreement had been made directly between themselves and myself but now Claims Advisory are saying that I owe them for the commission for this claim yet only the week before they were still sending letters for "further information to process the claim". I will pay this to Claims Advisory if I should but at this stage I dont think that Claims Advisory actually provided any service to me and that my own initial correspondence to Welcome was actually what initiated and in the end closed the reclaim case.

Can you please advise what position you think I am either if I should be honouring the payment to claims advisory or that I am within my rights to tell them that I wont be paying?

Thanks
Mich

You will find that claims companies are very good at including things like this in their T&C. So, even if you get the payment and they have done little towards it, then you still have to pay them.

Only way to fight it is play them at their game. If you feel the contract term is unfair then take legal action against them or let them take a small claims case to court against you and fight your corner saying you believe the contract term is unfair.

If, by their own admission, they hadn't processed the claim then I can't see they have any justification for charging a commission for work they clearly didn't do.
