Yorkshire Bank says NO WAY

I sent my first letter off asking for all my charges back and I received one back politely saying go away and if I choose to take it further they will lodge a conuterclaim against me for damages suffered as a result of the breach by me of my contract with the bank. Any suggestions???

OMG thats a bit nasty! what sort of damages are you believed to have caused them? That was my worry about applying, that they would get nasty with me (I am with Abbey)£2 Savers Club - £36 (Started 17.11.06)

who knows? I'm assuming cos I didn't run my account in credit. They've sent me loads of jargon which reads veryt worrying. Its enough to put someone off.0 -

thats exactly what it aims to do , put you off.If you look on the consumeractiongroup.com web site you will see how many others have recieved letters like this and how they replied to then.You will also see how many who have recieved them also now have their money back .No one can expect the banks to roll over and pay you out right away they are going to use bluff and IMO bully boy tactics like this to scare as many off as is possible as obviously they don't want to give people their mopney back.You will find all the support you need from the consumer action group.0 -
Does anyone know if I can I claim for credit card charges (over agreed limit / late payment) like I can claim from my current account.

It seems that Yorkshire Bank like to issue counterclaims now.
There's currently a few members on the Bank Action Group battling against counterclaims, you should have a look on there as soon as you can.0 -

Hi I am asking the same question, Apparently (dont quote me) you can claim from creditcard companies aswell, I have noticed that they have now dropped their charges to £12.00 so I reckon they must be re-claimable as well
wht I would like to know, is can you claim back late charges from storecard companies and catalogue companies aswell, as that is a form of credit isnt it?
Hope fully somone can answer our questions.

Yes, you can claim for any disproprtionate penalty charges including 'late payment fees'.0 -

Yes, am currently dealing with CapitalOne for my daughter. They have already credited her account with £96.00 but am just putting in court papers for the other £150.00 as they refused to refund the rest.

Let us know how you get on Diggerb ... and in answer to your question ..yes .. you can claim back your penalty fees from anyone who charges you unlawfully .. credit cards .. store cards .. mortgage companies .. phone companies etc etc .ALL penalty charges are unlawful these companies are only allowed by law to charge you what it costs them so eg if you are late paying your phone bill it does not cost the phone company £20 so if they charge you that is also an unlaful charge .Also please be aware that the £12 figure that the banks are now charging is still not a legal limit as this can only be tested in court the £12 is what the OFT said they them selves would act against and they stressed that £12 may still be an unfair amount .0
