Barclarycard ! reject Claim

Options
Hi

Sent Letter in July 2010 to claim the PPI was mis sold on my Barclaycard , after chasing and chasing and the usual stall techiques used by barcalycard , I managed to speak to someone in the directors office this morning , (yes they answer phone at 8.25am) , I have been told that my claim has been rejected but they said they couldnt go into the reasons why it was , as I have passed my complaint onto the FOS , so i need to speak with them on this issue.

So what should I do next ?
Should I speak to the FOS and ask them to fight for me ? I have already sent letter to them mid-dec 2010 and Barclaycard know I have forwarded it to the FOS

Does anyone have any stories to share of what to do for the best !

You have said that its already been referred to the FOS. So, you don't need to do it again. You need to realise that the FOS won't fight it for you. They will look at your complaint. They will look at the rejection reason, check the available evidence to support your accusation and check the evidence Barclaycard give to support their response and then make a decision.

Tell the truth, don't lie (as if you are found out by evidence to the contrary then you will usually end up losing where a balance of probability decision is required). Apart from that, you are largely in the hands of the FOS now. So, that means a 2-12 month wait probably.

FOS dont fight for you. They are independant and therer to settle complaints between you and firm from a neutral point of view.

There is a misconception that FOS are there to be a consumer champion, but this is not the case.

Only by people who have complaints not upheld by FOS!
We've spent decades teaching people about their rights, but nothing about their responsibilities.
