Problems with Arnold Clark

Hi,

I am new to posting to this, but have been reading for a while. Hope I am doing this right...

I have a problem with Arnold Clark and wanted to see if anyone could give me some advice.

I bought a new car at the start of the year, my old car was on a hire purchase agreement and they agreed to take it from me and pay off the rest of the finance. I asked if I would need to make any more payments to the finance company but was told no as the next payment wasn't due till much later on in the month and I would have the new car by then. Anyway my new car was a few days late as they messed up some of the paperwork regarding a cherish transfer but I got the new car a good few days before any payment to the old car was due.

I then got a letter through the mail about 10 days later form my old finance company saying I had missed a payment and I was being charged a late payment fee. I called and explained I had sold the car to Arnold Clark and the girl laughed and said this happens all the time. The dealership wait for ages to pay off the finance. I contacted Arnold straight away and they got back to me the next day saying that they had forgotten to get me to sign a document so I went back to sign it, after that it took a further 8 days for the finance to be paid off. In the meantime I was calling the finance company every day to check if it ad been paid yet.

I have just got my credit report and noticed it has been put on as a late payment. I have put a note of explanation on it and have called Arnold to scream at them today but they just said they will get back to me.

I just wanted to know if there is anything I could do? I have never missed a payment for anything in 10 years and am totally gutted that this is now on my report.

Any help or advice would be great!!

  • No nothing you can do; It is your responsibility to pay the agreement on time until such a time it is settled; you can not pass this obligation on elsewhere. This is very common with such transactions and the terms will have small print about this.

Unfortunately at best you will get a goodwill refund from AC but the late payment will stand.

Learn the lesson and move on.
