Help what are my rights with this retailer

Bought a cooker from a small local retailer on 26th Jan...paid in cash the next day to be delivered on 03/02/11.........I'm still waiting ...despite numerous phone calls he has fobbed me off...tsaying yes it will be tomorrow.......he has a key because my son has not yet moved in ( until he has a cooker he cant )
think he's waiting until he has another delivery in that area ...although its only around 4 miles away.
going to ring in the morning ....and maybe say i have spoken to trading standards....? is he in breach of ( verbal ) contract...please advise me

Did you receive a receipt/invoice when you paid? Hopefully you have some evidence that the seller has your money?
If he's ducking your phone calls, I'd probably personally go to the shop and demand that either he gives you a full refund or delivers the cooker within 48 hours (be specific but be reasonable - don't demand that he closes the shop immediately etc). Make sure you tell him that you're being reasonable specifically to enable him to repay the favour by keeping his side of the agreement.
If that fails, contact your local trading standards office and inform him that you have done so.

It might be that as it is only a "small local retailer", they may no longer have enough of a turnover for them to be VAT registered (I think it's about £70,000 per year), and rather than pay for a new batch of invoices, may be using up stock ordered when they were liable for VAT0

You need to (hand?) deliver a letter to him stating that time is now the essence of the contract, giving him a reasonable date by when you expect him to have delivered the cooker, or he will be considered in breach of contract - and get your key back off of him, today!"You were only supposed to blow the bl**dy doors off!!"0
