    This might not be relevent as I don't know exactly what forms you have received.
    If the forms have come from a small claims court then I must emphasise that they need to be sent back ASAP. 7 days seems a very short time. The reason I am saying this is that I am in the process of taking someone to a small claim/fast track court and they had 28 days to answer.However if there is no reply within that timescale the claiment is sent another form to claim the money, and it can be awarded without even going to court.
  • Send to your insurers. Its likely your insurnance also came with legal advice included.

    Its likely the other party has been sucked in by an ambulance chasing claims company. I've noticed an inccrease in cold calls at home which when I answer have recorded messages like - "Have you been in a accident in the last 6 years, did you suffer injuries, stress blah blah blah blah blah".

    Not to claim for damage to their car they wouldn't

    Hi,

    Dont know if this will help you but i can give you my experience.

    I was involved in an accident 3 years ago now which was deemed my fault. The man in the other car already claimed for personal injury from my insurance company, so I thought everything had been settled.

    Then out of the blue 8 months later I got a court summons claiming for more personal injury money. It was 1 day before my end of year exams!!

    I simply contacted the insurance company and faxed everything over to them, posted things recorded post and thats the last I heard of it.

    The insurance company stated that all documents should have been posted to them and this was a standard scare tactic trying to get me to pay out without getting the insurance company involved.

    Also I would like to point out it was the lovely people on here that answered my post at 2am when I got back from the library and found the summons!!:T:T

    The advice you have received here is solid. But please remember MSEr's cannot offer advice, only opinions.. My opinion would be just hand it all over to the insurers with lips closed, as stated by many earlier;)

    Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)
