Compensation for stolen car??

Wednesday night i had my car stolen. It was taken to a scrap yard and crushed.

The car was parked in an allocated residential parking spot. It was SORN, but had no insurance, as the car was being repaired. The car was dueto be MOT'ed this friday.

Police are dealing with this, but where do i stand in terms of compensation?

Can i claim back the cost of the car, parts that had been put on the car to make it road worthy, and the contents of the car. I have pretty much most of the receipts.

Can i claim some sort of compensation for the aggro it has caused, and the fact i now have to go out and buy a new car??

    Claim compensation from who? Who stole it?
  • Whoever is liable. The thief and the scrap yard for knowing accepting stolen goods??

    It was stolen by a local scrap merchant. Those people that stick flyers on your car or through your door offering to scrap your car for you. They took it to a local scrap yard and they scrapped it.

    Shot yourself in the foot for your most likely source of compensation. You really need to at least maintain off-road insurance in these circumstances.

    Was the parking spot on private land because if not the DVLA could have towed it as well? Also you would have needed insurance.

    Surprisingly, it is illegal for a scrapyard take people's cars and crush them without their consent, so if you have sufficient evidence then the police would undoubtedly be interested, and can also advise whether a compensation order can be requested at the criminal court.
    The local authority licensing dept should also be interested in breaches or the scrap yard's licence.
    It is possible that the council have decided it was abandoned and arranged for it to be removed and scrapped - but they will have a record.

  • The police are fully aware and are prosecuting this week. There was no consent given to take the car in any way shape or form. If the council are involved then there has to be a reasonable attempt made to contact the owner. There were no notes posted through the doors, or posted on the car.

    If the Police are prosecuting the scrap merchant then ask them to submit to the CPS a claim for compensation and for any expenses incurred in the search for a new car. Otherwise if you miss this then you could ask them for the scrap merchants name and address so that you can claim compensation via the Courts. Whether it's worth it is another matter if the guy has no fixed abode or deals in cash and hides his dealings.

    sounds like a dodgey scrap yard too.. my local scrappies wont touch a car without the log book..

    What you have is evidence that they scrapped an untaxed, uninsured, unMoT'd car and some receipts for parts that may or may not have been on the car when it was scrapped. I don't think you'll be retiring on the compo:(.
