More Success- Halifax reclaimed £180 BUT condition - all future charges stand
spilling
Bank: halifax
Amount Reclaimed: 180
Amount they paid: 180(charges due to be applied after I wrote first letter)
The story: They paid up after first letter
BUT they wanted me to sign a form saying
1. this is full and final settlement in regards to those charges
2. I accept that charges will stand in the future-
I WAS STUPID ENOUGH TO HAVE SIGNED!
Now I have more charges- when I phoned to ask for a refund on these too I was rudely told that I should be in more control of my account- hence the charges and that no refund would be given. I threatened to close my ac of
15yrs and was bluntly told if that is what I want to do that is ok pop to my local branch.
To close the account would be a hassle - do I have any grounds to write again to claim back a further £120 taken over one week?
Can they hold me to signing this paper to accept future charges?
Any one any suggestions.
Thanks
Suzanne

Some of the people I've read about who have claimed successfully have made it a condition of the settlement that charges should be proportionate from then on.... or something like that.
Whether or not you can claim again after signing that declaration though, sorry I can't answer that. ^^"The reasonable man adapts to the world,

You really should not have signed that. And I'm afraid I don't know the answer it could be legal and binding, but I'm sure you never agreed to huge penalty charges.
I never signed mine and will be after them again shortly. I rang up about them and the girl said "don't bother with all the letters just go straight to court because you obviously don't agree with the charges" and we won't give them you back.
So after Barclays I will be after them, then again I might squeeze them in between

You're in a difficult position now.
For future reference, when you have won your case, the bank are in no position to make demands like this. Either cross them out and send the letter back or demand they pay for such a declaration. Make up a figure of £1000 or something.0 -
They might well close it for you.spilling wrote:To close the account would be a hassle0
