Housing Benefit Query

            I have a query. I have a property mortgaged under my name. Can I rent this out to my parents who are entitled to claim housing benefit?
 Unless you treat as a proper landlord/tenant, with the appropriate
 gas certificates, normal market rent etc. etc, Then it a big no no##
 Its then classed as a contrived tenancy so you have to look into it a lot more.make the most of it, we are only here for the weekend.

            I didnt explain my self correctly it seems.
 We both moved into this property on Jan 8th 2011 as joint tenants. Legally we are both responsible for half the rent.
 I did fill in the housing benefit forms correctly with my information only. As I am the only one claiming and I do not have a partner. I did explain on the backpage of the form that I am in a house share.
 I would also like to add I have not received any hb payments for this property as my claim is still going through. Therefore there is no money to pay back as I have not had any.
 It seems some people on this forum cant be civil, and yes I did want some peoples perspective on this!0

 As long as you told them on your form you were sharing the house with a joint tenant and only paying 50% of the rent, i can see what you mean aabout not having lied. you just need to make sure you tell them every bit of information when you complete your form, otherwise yes they will want to investigate you, as you have not mentioned this to them?
 if you are truely living separate lives as joint tenants you could ask if a visiting officer from the council can come out and see your lviing arrangements which may help to prove your casE?0

 Oh get real! No authority is going to believe you share a house with your ex and you have drawn white lines down the middle of the bed, sofa, living room etc to indicate you are both strangers but in the same dwelling!

 I assume you're in a private let if so I had someone come out to check I was in the property myself with my son, they didn't poke around or anything though. You need to make sure washing is seperate as is shopping just for the day they come so if they do poke around they won't find anything.
 If he has a girlfriend and she stays over make sure that any of her stuff isn't around in his room as they may not believe it is someone elses.

            Surely if he has a girlfriend, then you can make sure she is there when they come and visit and she can say that she is his girlfriend and she knows about the arrangements and ok with it because she knows you guys are not together.
 To be fair, if we assume you are totally genuine and indeed are only friends, surely you can't be surprise that the council would question your arrangement. Surely you would have made it clear on the application that you are sharing with your ex partner, but that you are now genuinely only friends and you are happy for your to be interviewed etc... You have to accept that your situation is rare, whereas couple trying to pretend they are not a couple to cheat benefits are much more common.0

 First off I am not advocating or encouraging benefit theft, she said she has told them they are living seperately and as friends and he has a girlfriend, when looking to see if people live as a couple they look at washing/shopping. Entirely innocently they may be doing washing/shopping together but could be refused HB because of this.
 Second of all do you know my circumstances? Thought not, maybe best to keep it shut when you have no idea what you're talking about, not everyone receiving LHA/HB is doing so because they don't work!
