double booking

Booked a holiday and paid by credit card on 6.2.11. 14.2.11 company contacted us to say we were doulbe booked and offered us an alternative hotel which we weren't happy with. Eventually we both agreed on a 5* hotel (our original booking was 4*) and I was given the impression there would be no extra cost involved. The company agreed to ring back within 2 hours to confirm the room we were getting. They didn't. Or they said they did but I didn't answer, not true. We phoned the next day they said we had the same booking as before (1/2 board) and a sea view room. No confirmation was sent. The following day we rang again. Definitely booked. They would confirm. Next day we again phoned, they said we had booked B&B only and there was no sea view. They also said that I had accepted the booking and had been told it was B&B only. I was not told this and was waiting for the promise phone call. Now they are supposed to be listening to tapes of conversation apparently but we haven't heard anything yet and we are going on 1.3.11 and have no confirmation etc. We don't want B&B. Can we cancel? Or what are our options?

They most likely have booked your holiday seperately (DIY)
Your most likely to have flights booked with a low cost carrier, the agent must of made the mistake and they are probs trying to resolve the matter
I would hound them to resolve this they probs dont want to take the loss on the booking and trying to get out of itI am a Travel Agent

Have been on to airline and made sure we have the flights. however it will cost £400 to upgrade to 1/2 board. If we wanted to pay this we would have booked that hotel in the first place. do they have to pay? Or do we? Are we entititle to cancel?
