Court soon with ex friend

Sorry in advance if this is posted in wrong area.

I am at discloser of document stage and have lost confidence and need more help other site have helped alot but feel very alone at the mo.:(

Ex friend lent me money on a pay back if and when you can basis. Was substantial amount. Paid nearly all back but claiment want rest paying back to her credit card, she was also my employer. so i did this then things got nasty and she was trying to get me sacked in work. she asked me to check and sign a credit card statement to say that i would pay back what i owe , but trouble is i did not owe that amout and she then added i was liable for 23% interest i made 4 payments and stopped... offered to pay back what i owed and did not want to know as she is nuts!! and wealthy not a good combo.

Now she is taking me to court is claiming over 9000 for a 3000 dept and has managed to get witnesses to lie for her ....Im really stuck and suffer from panic attacks, i cant get legal aid and cant afford a solicitor. i have done the whole cpr requests etc and filed a defence as she has not even supplied bank statements showing what she lent.

    Unless you signed a contract saying that you agreed to pay 23% interest she doesn't have a leg to stand on.

    This is horrible, because, it will come down to her word against yours and that can be very stressful. Being taken to court is upsetting whether you're right or not. It's also worrying that you think she has people who will lie for her. Go to court and tell the truth. It's all you can do. Have you got friends and family to help and support you?

    You could also look into whether your friend would need a licence to be able to charge interest on a loan.

    What did you actually sign?

    If there is nothing saying you agree to pay such an interest payment, and you can prove that you've already paid back the £3000, then I really don't see how she can win in court.

    You can represent yourself. Just stick to the facts and don't waffle.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    She is more chance of being charged as a loan shark than she has of winning a case based on this interest rate. Like has been said, she can't just make up an apr and expect to get away with it. just stick to the fact's if it gets to court, but I doubt it will. If she keeps harrasing you report her to the police as being a loan shark, that will shut her up.

    is the 23% the interest that she has paid on her credit card for the money she lent you? did she use her credit card to loan you £3000?

    you only need a licence if you offer credit 'other than ocassionaly' or some other wording, it basically wont cover 1 off transactions between friends
