Court Claims form

A debt has been taken to court and a claims pack has arrived, Inside is a court claims form asking for personal details..out goings and wages..Ect.
1...Does this have to be filled in ? What would happen if it wasnt ?
2...Once filled in and returned. what happens next ? will a chance be given to pay without a attachment of earning being applied for ?

It's not 100% clear but I take it somebody is taking you to court for a debt?
If so failure to fill in the court forms would IMO make it more likely that a attachment of earnings order be made out against you should you lose.
Is there any reason you don't want to fill in the form?0 -

I got the finance for someone else as a favour and they havent paid it and this is what it has come to...worried sick if Im honest never had anything like this happen to me. Its all new to me...bloody annoyed.
i just dont like letting everyone knowing my buisness as regarding filling in the forms. I will have a ccj against me now. :mad:0 -
If you pay it withn 30 days no ccj will be issued, you are recommended to fill the soa in for the court. If you dont they will hit you anyway with the attachment of earnings.0

Well i cant afford to pay it off thats for sure...so i will fill the form in....would I need to offer a stupid amount a month

Forget your mate this is now your debt.
You still can go after him in the same way but of course if he says he has no money you are in s**t's creek.0 -

It depends on your circumstances. You normally have complete what your income is and then what your expenditure is. You then can offer £X amount as a payment each month it is then up to them to decide whether to accept it or not.0

I would not advise lying on the court forms. Can you afford to pay the regular monthly sum? If so it would be advisable to pay this (and get in touch with the company saying you will pay this as agreed and covering their court costs if they drop the case (unlikely but perhaps with an explanation for non-payment they will accept.))
If you cannot, fill in the SOA and as far as I am aware you'll pretty much have to offer (give maybe 10%) of your non-essential income (assuming no other debts).
However this is the wrong board for this, you will get better advice from the Debt Free Wanabee Forum.0 -
