Redundant....but maybe not!!

May 2010 my Husband was told they were shutting the factory he worked at & all would be made redundant.
They were even quoted the cash payout they would get + bonuses.

So OH has been on some courses which we have funded to help him find new employment. He has also been doing part time retail work to gain experience of customer facing.

The looming redundancy & extra work have left him emotionally & physically exhausted.

Fast forward to feb 2011.....

The workforce have now been told they have a buyer for the company & are stying open but under another name.

They have not been told their contracts rate of pay hours etc.

They will NOT be getting a pay out, but will also not have their service continued.

Now we are pleased he is still in employment but wondering what else they can spring on us!!

We are just wondering what are rights are about this....can they legally mess people about like this?

    Don't think your husbands job is safe as the companpany could pull out at the last minute but if they don't and do take over the company they still could move the work from there to save rent on two places.

    (A) Under Transfer of Undertakings legislation, the new company would have to take them on on their existing terms and conditions.

    (B) If they are buying the company, the employment would be continuous.
  • Was the Company in liquidation when the buyer was found? This would be the only time when contractual requirements would not be transferrable under TUPE.
  • No not in liquidation.

    They are keeping their jobs but NOT continuing their service apparently. So Oh has lost 25 years service
