I really need advise on what I should do next. I had not looked at my credit report for over a year and all of a sudden for no particular reason, I looked at it today. To my horror, there is a default on there for £28 from T-mobile from back to 2009. Apart from paying the £28 which I will do, the fact that it was put on my credit report as a default has screwed me up. I can't believe my life is screwed for the next 7 years because of £28 which I wasn't even aware that I owed. Does anyone have any advise of how I can fix this apart from paying the £28 which I am going to do ASAP?

Write to T-Mobile recorded delivery.
State you were unaware of an outstanding balance, you were not asked to pay an outstanding balance, no direct debit for the alleged balance was requested from your bank, and you most certainly were not given a chance to bring the account back up to date given no warnings or requests for money were sent to either you or your bank.
Follow this up by stating that given the above facts, the default recorded is misrepresentative, inaccurate information left on your credit report in breach of the Data Protection Act.
Close by stating you are happy to pay the amount owed UPON RECEIPT OF WRITTEN CONFIRMATION THAT THE DEFAULT WILL BE REMOVED IN IT'S ENTIRETY from your credit file and not just marked as satisfied. Advised that failure to comply with this request will result in a complaint being brought against them via the ICO.
DO NOT PAY THEM A PENNY until you've had written confirmation that they will comply with your request. Send the letter recorded delivery and provide them with 30 days to return with the requested agreement.
I've helped a few friends out locally with this method and it has invariably been successful, albeit sometimes they've had to follow up with more letters. And guess who's been to blame before? Usually T-Mobile but once Three Mobile.

I have the same problem with Virgin Media for £24. I have requested all reminder letters, default notices etc to be sent to me, but they don`t reply, so I assume they don`t have them(which os often the case). If they do not provide, they have no legal ground and have to remove default from your credit file. Complaining to ICO will take months and in my opinion is waste of time. They never sent me anything regarding my case in 8 months time. Useless.0 -

Good luck with this.
Give VM have point blank ignored you and the ICO have not been of help it might be worth writing to VM's registered Head Office address as per Companies House with the heading "PRE-LITIGATION ADVICE" cetralised at the head of the letter you send them re-iterating the points you've already raised with them and the ones I've raised above.
In my experience this normally gets the ball rolling. These companies are appauling to deal with but once they realise you mean business and are fully aware of what laws they have broken and are preparting for an open and up civil lawsuit they get their ideas in shape
And don't be afraid to issue them with court papers. If that's what it takes, go for it. If they can't substantiate their erroneous claim that they provided you with ample time and warning to bring the account back up to date the data has been left on your credit file illegally - end of.Cashback Earned ¦ Nectar Points £68 ¦ Natoinwide Select £62 ¦ Aqua Reward £100 ¦ Amex Platinum £48

I just recieved a written response from T-Mobile and this it what they said, "According to our records the amount of £27.41 is still oustanding. We would be pleased to update your credit file once the overdue balance has been setteled in full." Do you guys think they mean the default will be taken off my credit report or just marked as satisfied because in my letter I wrote that it should be taken of in its entirety. What do you guys think?0
