CSA Payment £1200 a month?!!!!

    He stopped making the payments as the agreement he had with the mother of the child was that he would make payment until his 17th birthday as he was to leave school at 16. Unfortunately my OH was not informed that he the child was continuing in full time education, had the mother made him aware of this he would have continued the payment without a doubt. We just seem to be at a bit of a dead end at the moment as getting so much conflicting information and seem to be getting nowhere with it all. Based on the phone call she had with my hubby last night we are now looking to take the matter to our solicitor as the mother announced 'I know you're not his Dad but I'm gonna screw you for everything' I've no idea how someone could be so malicious it's really quite sad. My OH was recording the call at the time (which she was aware of also)

    Not sure I can really offer any advice, but I'm not sure a solicitor would be able to do much as they tend not to get involved with child maintenance issues nowadays with the CSA having all the power in that area. Money might be better spent on an approved DNA test so you can fight this! Good luck!

    Thanks for your kind words, it was really awful for me to have to sit and listen to her talk to my OH like that, really shows what some people are like. OH has said he will go down the DNA route to get this matter sorted so fingers crossed we can get something sorted.

  • I say this to everyone at the moment because I cannot stress enough what a difference it has made to my own CSA battle (from the PWC angle) - if you get no joy with the CSA, involve your local MP. Just the mention of them in my complaint letter jumped them into action and resolved months of stress. Amazing how quickly they can do assessments with an MP breathing down their neck!!!

  • Just want to say good luck, and sad to hear what has happened, mostly sad for the young lad in the situation if his mum is as you say she is. He doesn't deserve that, no kid does.

    If I were in your shoes I would be encouraging the paternity test all the way. However, sounds to me like the PWC is playing stupid games. I can't fathom why they want to do this. Good luck, hope it works out best for all.

    Thanks for your comments, it's very sad indeed. My OH is definately going down the paternity test route and hopefully we'll be able to sort this matter.

    And to the person on here sending me private messages - Yes my husband and I have a successful business, but this alone does not give you the right to send me such messages and you really ought to be ashamed of yourself because your comments are disgusting!

    you don't have to do it within 30 days either. both sides can apply for re-assessment anytime they like and the csa are legally bound to oblige.


    If the CSA haven't been given the correct information by the NRP then they have to use whatever info is available to them, in this case it will have been the most recent tax returns from the NRP's company.

    The NRP has to dispute the calculation within 30 days if they want that particular calculation to be revised, otherwise any change will only be applicable from the time that the NRP calls the CSA.

    Before you go down the expensive line with a solicitor have you looked at the link I gave you regarding Nacsa?

    Or................To simplify the process somewhat you could subscribe to NACSA and get them to deal with case/CSA on your behalf, they are excellent and know CSA Law better than the CSA staff themselves.

    We had massive probs with CSA as my hubs s/e, CSA assessed him on totally silly amounts of money which legally should never have been used to form part of CSA assessment. We appealed the monthly figure and arrears of over 34k they said we owed, but this process islengthy, so in meantime CSA took him 2 Court for LO, got a CCJ, took us to Court twice to obtain charge on our house plus also sent the bailiffs 3 times........................................We won the appeal, have they apologised......er no

    If you do decide to go the DNA route I hope for you husbands sake the child is his, otherwise all these years he will have been paying for another man's child. If the child isn't I hope there will be some kind of recourse for recovering monies paid in good faith.

    Could your husband agree with the CSA to continue payments at the previous rate until the child is eighteen and in full time education. Also explain payments only stopped at the agreed time as discussed with the child's mother.
