Do you have the same landlord? I'm sure behaviour like that would breach his tenancy, maybe another option?
No not the same landlord. Mine is in dialogue with the attackers - however getting the attacker evicted doesnt make me feel any safer. He knows where id be living and could potentially keep a key to the communial entrance.
I would go back and carry on as normal now. Its unlikely to happen again now he has been arrested, dna taken, fingerprinted, photographed, cautioned. He probably feels a right idiot. Being on medication does not mean he is a loon, probably 30% of everyone is on medication.
I understand what you mean, however he has been shouting in a rage at night for the past few months - to a level i dont think i could flip out too. The fact he never had a conversation with me previously about the dog muck and decided this was the best way to communicate the issue with me suggests he isnt stable - and one of the bad ones in the 30%. Im not against housing people with medical issues, but only if they are fit for society. If he had done that to my girlfriend this would not be assualt but a murder case.
When you rang the police did anyone come and see you? - Have you given a statement? Do you have bruises?
Yes - 2 hours after i phoned 999 they arrived (they were having lunch!). Complaint to police made about assualt, they then arrested him 24 hours later (despite me being terrified and him being downstairs), yesterday evening pressurised me on the phone to make a decision on whether I (yes I) want to let him off with a caution or be prepared to go to court. I wasnt allowed to phone anyone else or even have 15 mins to make a decision. I said I would go to court. then they phoned back 2 mins later saying he is getting a caution. - What was the point in asking? Yes have finger marks where he tried to suffercate me to death - photos taken. He put a note through my door saying sorrying for grabbing your neck heres a fiver for a drink! - so must have admitted it. Im taking pain killers but cant sleep as in constant aching pain in neck and shoulder.
The OP says he cannot go back - yet it is not the landlords fault, and the rent and the notice period are still legal requirements.
spot on - unfortunatley.
General update -
Been to police station today to ask about decision and whether i can have my statement/photos/admission note. I have to speak to the PC only and he isnt working today - no one else would speak to me despite telling them im now homeless.
I checked with an independent estate agent and he confirmed what was said above. Its not the landlords fault that he hasnt protected me from the outside world. And that is right. So its whether he understands that he makes me continue by giving two months notice i will be financially crippled and either starve/be energyless or be homeless.
BTW did you know that no government/council agency around homelessness are open on a weekend. Unbeliveable.

Your local authority homeless service will be available to you 24 hours a day, 7 days a week. Most have an out of hours telephone service you can reach via the local authorities emergency contact number. The Police will be well aware of this.
Due to the nature of your current situation, the LA SHOULD offer you emergency temporary accommodation and investigate the matter under a homeless application. Your priority will be "fleeing violence" and comes under the same broad remit as Domestic Violence. Be warned that they may be less than willing to accommodate you as (I presume) a single adult with no dependant children, however, they have a DUTY to do so while they make the necessary enquiries into your homelessness.
Temp accommodation will almost certainly be a grotty B+B and I would encourage you to consider any other alternatives (friends/family etc) first.
As to your rental liability? Your landlord has already compromised to a certain extent by offering you a 2 month liability. Whilst your neighbours actions aren't your fault, neither are they the fault of your landlord.0 -
If you want to get shot of the landlord, tell him that you're going to make sure a violent crime is reported to the police and will appear right on the property on https://www.police.uk :A0

999/2 hours. As he'd left it wasn't really a 999 job. It's 999 if your gf rings it while he's still got his hands round your throat.0

I disagree.
From the Met website:
In an emergency always call 999
An emergency is when a crime is happening, someone suspected of a crime is nearby, someone is injured, being threatened or in danger.British Ex-pat in British Columbia!0 -

Someone suspected of a crime is nearby: more about WANTED posters and people wanted of a crime that the police are looking for
Being threatened; that's a present case, he was threatened and the loony left
In danger: He wasn't in danger, the bloke'd left.0 -
I feel sorry for you. My advice would be to contact the citizens advice bureau and get some helpI am not a financial expert, and the post above is merely my opinion.:j0

Mikey,
You said that the assailant was released with a caution.
A caution is a criminal sanction. He has been arrested and admitted in i/v that he assaulted you.
He would have received a caution only if he admitted it and his criminal record allowed it (that's even if he had any previous convictions).
You say that you're scared that he'll come around again. If he does the best thing that you can do is to refuse to open the door. If you're scared for your safety phone the police on 999 and tell them that - tell the operator whether or not he is at your door and what he is doing.
You say that you attempted to speak to the PC who was dealing with the case. There won't be a great deal more to say as it's closed and the offender has received the sanction so I don't know what else you need to know?
You also say that you're not happy with the charging decision made by the police. Unfortunately it's not down to the police to decide who gets charged and who doesn't - that's down to the Crown Prosecution Service CPS). The decision may have been made to caution him rather than the CPS not run with it at all (i.e. the CPS decide to NFA him and you have no result at all).
I wish you all the best finding a new home though, no-one should have to deal with being assaulted on their doorstep.0
